Testimony Terms and Conditions

Offer and Acceptance:

This Terms and Conditions of Use Agreement (“Agreement”) is a legally binding agreement between you (“you” “your” “customer” “client” “user” or “users”) and Catching Sisters (“us” “we” “our” “Organizer” “Group”). This Agreement sets forth the terms and conditions for your submission of testimonials through our Google Form. By submitting this form, you confirm that you have read, understood, and agreed to the terms and conditions outlined below. This constitutes an offer to share your testimony and personal information, which is accepted by submitting your details.

You agree to all terms related to the use of your information as described, including but not limited to, the collection, use, and distribution of your testimony for the purposes stated.

Purpose of Collection:

The information collected in this form, including your testimony of how Jesus saved you, your name, age, country, and city, will be used to inspire and encourage our community on our social media page.

Data Usage:

We will use your response to feature your testimony publicly on our social media pages and website. This includes your name, age, country, and city.

Consent Statement:

By submitting this form, you, the undersigned, hereby grant Catching Sisters (“us” “we” “our” “Organizer” “Group”) a perpetual, nonrevocable, worldwide, royalty-free, and unrestricted right and license to use, reproduce, distribute, display, and create derivative works from your submitted testimony, including any accompanying personal information (such as your name, age, country, and city), for any and all purposes, including but not limited to, advertising, promotion, and social media postings across all platforms and media now known or hereafter devised.

Rights to Edit and Modify:

You understand and agree that we may edit, modify, adapt, or reformat your submitted content, including any accompanying personal information, to fit the needs of various media formats and platforms, while still maintaining the integrity of your original message.

Right to Refuse or Not Share Submissions:

We reserve the right, at our sole discretion, to refuse, edit, or not share any submitted testimony on our social media platforms or other media. Submission of your testimony does not guarantee that it will be published, and we are under no obligation to provide a reason for our decision.

Consideration:

You acknowledge that your submission is entirely voluntary and that you will receive no monetary compensation or other tangible benefits in exchange for your participation. The consideration for this agreement is the opportunity to share your testimony and be featured on our platforms.

Waiver of Personality and Privacy Rights:

By submitting your testimony and personal information, you waive any rights of privacy, publicity, or personality that you may have in connection with the use of your submission, as described above. You also waive the right to inspect or approve any materials where your testimony or personal information appears.

Voluntary Participation and Intention to Create Legal Relations:

You confirm that your participation is entirely voluntary, and you have no obligation to provide this information. By submitting your testimony, you intend to create legal relations and be legally bound by this agreement.

Exclusion of Liability:

You release and discharge Catching Sisters, its affiliates, employees, and agents from any and all claims, demands, and liabilities of any kind arising out of or related to the use of your submitted testimony and personal information as described in this agreement.

Indemnification:

By submitting your testimonial, you agree to indemnify and hold harmless Catching Sisters, including its affiliates, agents, and representatives, from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your submission of the testimonial. This includes any claims that your testimonial infringes on the rights of any third party.

Attorney’s Fees:

Any legal fees incurred due to the enforcement of this agreement by the Owner, if prevailing, shall be entitled to recover its reasonable attorney’s fees and costs from you. This includes collection fees and costs incurred by the Owner in collecting payment of any amount due under this agreement.

Force Majeure:

Catching Sisters  shall not be liable for any failure or delay in performance of any obligation under this agreement, if the failure or delay in performance is due to any cause beyond our reasonable control, including, but not limited to electronic or communication failures, electrical outages, network failures, pandemics, floods, acts of God, or other similar or different occurrences beyond the reasonable control the Owner. Force majeure events shall not include a party’s financial inability to perform its obligations under this agreement.

Agreement to Testimonial Release Terms:

By submitting this form, you confirm that you have read, understood, and agreed to the terms of this Testimonial Release and Consent Form.

Personal Information Use:

You grant us the right to use your personal information as provided in this form in connection with your testimony, for the purposes outlined above.

Confirmation of Consent:

By submitting your testimony, you confirm that you have provided your consent voluntarily and with a full understanding of the terms and conditions set forth in this Testimonial Release and Consent Form.

Age Requirement:

You must be at least 18 years old to participate in this submission. Your submission indicates that you meet the age requirement and confirm that you are 18 years of age or older.

Severability:

If any provision of this Agreement is held, in whole or in part, to be unenforceable for any reason, the remainder of that provision and of the entire agreement will be severable and remain in full force and effect.

Headings:

The headings used in this agreement are for convenience and reference purposes only and shall not affect the construction or interpretation of this agreement.

Entire Agreement:

You acknowledge and agree that this Agreement contains the entire agreement of the parties. No other agreement, statement, or promise made on or before the effective date of this Agreement will be binding on the parties.
